"Kimberley have lodged a complaint to the Australian Competition and Consumer Commission against Delorme (USA) under the “Competition and Consumer Act 2010” for breaching section 48 "Retail Price Maintenance" (section 48) and "Accepting payment without intending to supply" (section 58)"

The previous consumer price offered by a Kimberley reseller, Beam Communication was $265. Delorme complained that the “reseller could not support the brand” at this price and repeatedly asked Kimberley to cease supplying them. Kimberley refused to be a party to breach the “Competition and Consumer Act 2010” and as a result, Delorme wrongfully terminated the agreement with Kimberley.

The price offered by Delorme resellers in Australia at the time was $369.

The Amazon.com price was US$237.65.

The service level for product supplied by Beam and serviced by Kimberley was a higher service level for a similar minimum monthly service fee.

Beam Communications have now been approached to purchase the product through the other reseller dispelling the claim that they could “not support the brand”.

The "Automatic Australian Activation and Australian Service" by Kimberley were paid for but not delivered by Delorme.

Kimberley are publishing this information to name and shame the actions by Delorme.
